The EuroTermBank project focuses on harmonisation and consolidation of terminology work in new EU member states, transferring experience from other European Union terminology networks and accumulating competencies and efforts of the accessed countries. The project will result in a centralized online terminology bank for languages of new EU member countries interlinked to other terminology banks and resources. Although EuroTermBank is addressed directly towards Estonia, Hungary, Latvia, Lithuania, and Poland, the project is open to other new EU member states and interested countries and organizations outside EU.

I. General Provisions

Article 1. 1. The Act shall lay down the law governing international personal and property relations within the scope of civil, family and guardianship law, likewise the labour law.

2. The provisions of this Act shall not apply if an international agreement to which the Polish People’s Republic is a party provides otherwise.

Article 2. 1. Where statutory law provides that the national law shall apply, a Polish citizen shall fall under the Polish law notwithstanding the fact that, under the law of another state, he or she would be considered a citizen of said state.

2. The national law of a foreigner who has a citizenship of two or more states shall be the law of the state with which he or she has the closest links.

Article 3. Where statutory law provides that the national law shall apply and it shall prove impossible to establish the citizenship of a given person or the person does not have a citizenship of any state, the law of the state in which the person’s place of residence is located shall apply.

Article 4. 1. Where foreign law indicated as governing herein requires the Polish law to be applied to a given legal relationship, the Polish law shall apply.

2. Where foreign national law indicated as governing herein requires different foreign law to be applied to a given legal relationship, the different law shall apply.

Article 5. Where there are different legal systems in force in a state the law of which shall be governing, the law of this state shall stipulate which of the systems is to be applied.

Article 6. Foreign law shall not apply where application thereof would have effects contradictory to fundamental principles of legal order of the Polish People’s Republic.

Article 7. Where it shall prove impossible to establish circumstances which determine the governing foreign law, or where it shall prove impossible to indicate the substance of the governing foreign law, the Polish law shall apply.
